Art. 1. Preamble

Welcome to Yucuna, a digital platform, website, and mobile application developed and operated by Quattro Creative SARL (“Quattro Creative”, “Yucuna”, “we”, “our”, or “us”).

These Terms & Conditions (“Terms”) govern your access to and use of the Yucuna platform, including the website available at https://yucuna.com/, mobile applications, software, APIs, and related services (collectively, the “Platform”).

By accessing or using Yucuna, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

Art. 3. Eligibility

You must be at age or otherwise legally capable of entering into binding agreements under applicable law in order to use Yucuna.

If you use Yucuna on behalf of a business, company, employer, organization, or other legal entity, you represent and warrant that you have authority to bind such entity to these Terms.

Art. 4. Description of Services

Yucuna provides digital productivity, collaboration, management, communication, analytics, automation, monitoring, and business support tools accessible through web and mobile applications.

The Platform may include free and paid services, subscription-based functionality, integrations with third-party services, and enterprise features.

We reserve the right to modify, suspend, restrict, or discontinue all or part of the Platform at any time without liability.

Art. 5. Account registration

To access certain features, users may be required to create an account.

You agree to:

  • provide accurate, complete, and up-to-date information;
  • maintain the confidentiality of your credentials;
  • notify us immediately of unauthorized use of your account;
  • accept responsibility for all activities occurring under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

Art. 6. Acceptable Use

You agree not to:

  • use the Platform for unlawful, fraudulent, deceptive, or abusive purposes;
  • violate any applicable laws or regulations;
  • interfere with the operation, security, or integrity of the Platform;
  • distribute malware, harmful code, or malicious content;
  • attempt unauthorized access to systems, servers, or accounts;
  • reverse engineer, decompile, scrape, copy, or reproduce the Platform;
  • misuse analytics, automation, monitoring, or collaboration features;
  • infringe intellectual property, privacy, or data protection rights.

You remain solely responsible for all content, data, communications, and activities conducted through your use of Yucuna.

Art. 7. Business Customers (B2B)

Organizations using Yucuna are responsible for:

  • violanaging employee and user access;
  • ensuring lawful use of monitoring or analytics features;
  • complying with employment, labor, workplace surveillance, and privacy laws;
  • informing employees or users where legally required;
  • obtaining necessary permissions and consents.

Quattro Creative acts solely as a software provider and shall not be responsible for unlawful or unauthorized use of the Platform by business customers.

Enterprise or custom agreements may supplement these Terms.

Art. 8. Subscriptions & Payments

Certain features may require paid subscriptions.

By purchasing a subscription, you agree that:

  • pricing and billing terms are disclosed before purchase;
  • subscriptions may renew automatically unless cancelled before renewal;
  • fees are payable in accordance with selected plans;
  • taxes may apply where legally required;
  • non-payment may result in suspension or termination.

Unless otherwise required by applicable law, payments are non-refundable.

Payments may be processed by third-party payment providers. Quattro Creative is not responsible for errors, interruptions, or security incidents caused by such providers.

Art. 9. Consumer Withdrawal Rights

If you are a consumer residing in the European Union, you may have a statutory right to withdraw from purchases within fourteen (14) days.

However, by purchasing digital services or subscriptions and requesting immediate access to Yucuna, you expressly:

  • consent to the immediate performance of the digital service; and
  • acknowledge that your withdrawal right may be lost once performance has begun.

This provision is made in accordance with applicable EU consumer protection legislation.

Art. 10. Mobile Application 

Use of Yucuna mobile application may require:

  • compatible hardware and operating systems;
  • internet access;
  • device permissions;
  • periodic updates.

Certain features may operate continuously in the background in order to provide notifications, synchronization, analytics, automation, or security functions.

You acknowledge that:

  • carrier and internet fees may apply;
  • device performance may vary;
  • app store providers may impose additional terms.

Apple App Store may apply in addition to these Terms.

Art. 11. User Content Data

You retain ownership of content, files, information, and data uploaded or submitted to Yucuna.

You grant Quattro Creative a limited, non-exclusive, worldwide license to host, process, store, transmit, and display such content solely for the purpose of operating, securing, maintaining, and improving the Platform.

You are solely responsible for:

  • the legality of your content;
  • obtaining required rights and permissions;
  • ensuring compliance with applicable laws;
  • maintaining backups of important information.

We reserve the right to remove content violating these Terms or applicable law.

Art. 12. Data Protection & GDPR

Quattro Creative processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Depending on the nature of processing:

  • business customers may act as data controllers;
  • Quattro Creative may act as data processor or independent controller.

Art. 13. Intellectual Property

All intellectual property rights relating to Yucuna, including software, source code, interfaces, branding, designs, logos, graphics, documentation, databases, and technologies, remain the exclusive property of Quattro Creative or its licensors.

No rights are granted except those expressly stated in these Terms.

You may not:

  • copy or reproduce the Platform;
  • create derivative works;
  • use trademarks without permission;
  • exploit the Platform commercially without authorization.
 

Art. 14. Third-party Services

Yucuna may integrate with third-party providers, APIs, software, cloud services, analytics platforms, or payment providers.

We do not control and are not responsible for:

  • third-party content or services;
  • availability or uptime;
  • data processing practices;
  • security incidents;
  • pricing or contractual terms.

Your use of third-party services is governed by their own terms and privacy policies.

Art. 15. Availability & Disclaimer

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, Quattro Creative disclaims all warranties, whether express or implied, including warranties relating to:

  • merchantability;
  • fitness for a particular purpose;
  • uninterrupted availability;
  • security;
  • accuracy;
  • reliability;
  • non-infringement.

We do not guarantee that:

  • the Platform will always be available;
  • services will be uninterrupted or error-free;
  • data loss will never occur;
  • all bugs or vulnerabilities will be corrected.

Art. 16. Limitation of Liability

To the fullest extent permitted under applicable law, Quattro Creative shall not be liable for:

  • indirect or consequential damages;
  • loss of profits;
  • loss of revenue;
  • loss of productivity;
  • business interruption;
  • reputational damage;
  • data loss;
  • loss resulting from unauthorized access.

Our aggregate liability arising from or relating to the Platform shall not exceed the total amount paid by you to Quattro Creative during the twelve (12) months preceding the event giving rise to liability.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

Art. 17. Indemnification

You agree to indemnify and hold harmless Quattro Creative, its affiliates, directors, employees, contractors, and partners from any claims, liabilities, damages, costs, and expenses arising from:

  • your use of Yucuna;
  • your violation of these Terms;
  • your violation of applicable laws;

your infringement of third-party rights.

 

Art. 18. Suspension & Termination

We reserve the right to suspend, restrict, or terminate access to Yucuna at any time where:

  • these Terms are violated;
  • payment obligations are not met;
  • unlawful activity is suspected;
  • security or operational risks arise;
  • required by law.

You may stop using the Platform at any time.

Termination does not affect accrued rights or obligations.your infringement of third-party rights.

 

Art. 19. Applicable law and dispute resolution

The General Conditions and contractual relations are governed by Luxembourg law and interpreted in accordance with it. Any dispute relating to the existence, interpretation, execution or termination of the Contract will fall under the exclusive jurisdiction of the courts of the city of Luxembourg.
 

Art. 20. Changes to these terms

These general conditions may be amended or supplemented at any time, without notice, depending on the development or modifications of the services of QUATTRO CREATIVE.
Continued use of the Platform/Mobile APP after updates become effective constitutes acceptance of the revised Terms.
